Kangaroo Island Olives Pty Ltd (KIO) values customer privacy. The following privacy policy applies to all KIO users, and conforms to Internet privacy standards and the Australian Privacy Act. 1. COLLECTION OF INFORMATION
In order to use the KIO website, we may require information to process you order and provide the best service possible. All correspondence may be collected and stored, particularly in regard to sales data, support and accounts, including Email. Any information collected by KIO is collected via correspondence from you or your company. This may be via Phone, Email, Mail, Fax or directly through our website.
2. USE OF COLLECTION INFORMATION
Details collected from KIO customers is required in order to provide a high level of customer service in the delivery of our products. Correspondence is recorded in order to provide service references, and to assist in our staff development.
3. STORAGE OF COLLECTED INFORMATION
The security of your personal information is important to us. When you enter sensitive information (such as credit card numbers) on our website, we encrypt that information using secure socket layer technology (SSL). When Credit Card details are collected, we simply pass them on in order to be processed as required. We never permanently store complete Credit Card details. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it.
4. ORDERS
When purchasing product from us, invoicing will be from KIO and we may request certain personally identifiable information from you such as contact information (Name, Email, and Postal Address) and Financial Information (such as Credit Card Number, Expiration Date). We use this information for billing purposes, to fill your orders and to contact you if we have trouble processing an order.
5. COMMUNICATIONS
KIO uses personally identifiable information for essential communications, such as Emails, accounts information, and critical service details. We may also use this information for other purposes, including some promotional Emails. If at any time a customer wishes not to receive such correspondence, they can request to be removed from any mailing lists. You will be notified when your personal information is collected by any third party that is not our agent/service provider, so you can make an informed choice as to whether or not to share your information with that party.
6. THIRD PARTIES
KIO may at its discretion use third parties, such as payment gateway providers, to provide essential services on our site or for our business processes. We may share your details as necessary for the third party to provide that service. These third parties are prohibited from using your personally identifiable information for any other purpose. KIO does not share any information with third parties for any unknown or unrelated uses.

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our Website.

KIO uses several payment gateways for its online credit card transactions (including Stripe, PayPal, After Pay, Google Pay & Apple Pay). Stripe processes online credit card transactions for thousands of Australian merchants, providing a safe and secure means of collecting payments via the Internet. 11. SHIPPING POLICY
Order Confirmation
Once you place an order, you will receive an email confirmation containing your order details, provided you have supplied a valid email address. A system-generated confirmation is generally sent within a few minutes of placing your order.
Order Processing & Dispatch
We aim to dispatch all in-stock orders within 1–2 business days of receiving your order. Dispatch times may be longer during peak trading periods, public holidays, harvest, promotional events or when products are temporarily unavailable.
Orders qualifying for free shipping will be dispatched using the most cost-effective shipping service at KI Olives' discretion.
Shipping Rates
Shipping charges are calculated in real time at checkout based on your delivery location, parcel weight, dimensions and selected shipping service. We do not apply flat-rate shipping, ensuring customers only pay the applicable freight cost for their order.
We offer free standard shipping on eligible Australian orders over $100 AUD, excluding bulky items and any products specifically identified as excluded from free shipping. See 'Bulky Items'
Estimated Delivery Times
Estimated delivery times after dispatch are:
- South Australia: 1–4 business days
- All other Australian states and territories: 3–7 business days
Delivery timeframes are estimates only and are not guaranteed. Actual delivery times may vary due to factors outside our control, including courier delays, third party freight partners, weather events, peak trading periods, public holidays, remote delivery locations or other unforeseen circumstances.
Delivery
Orders will be delivered to the shipping address provided during checkout.
If no one is available to receive your parcel, the courier may leave the parcel in a safe place, redirect it to a collection point, or leave a delivery notification, depending on your delivery preferences and the courier's policies.
Where a parcel is redirected to a collection point (such as a post office, newsagency or authorised collection agency), you are responsible for collecting it. Once a parcel has been transferred to a collection point, KI Olives cannot relocate, redirect or otherwise intervene with the delivery.
Incorrect Delivery Information
Customers are responsible for ensuring all delivery details are complete, accurate and current before placing an order.
If you provide:
- an incorrect, incomplete or invalid delivery address;
- a previous or outdated delivery address; or
- any other inaccurate delivery information,
you will be responsible for any additional freight, return-to-sender, storage or redelivery charges incurred.
Australia Post Delivery Addresses
If your delivery address is an Australia Post PO Box, Parcel Locker, Locked Bag, LPO, Suite or any other Australia Post-managed delivery point, you must select Australia Post as your shipping method during checkout.
Third-party courier companies generally cannot deliver to Australia Post-managed delivery addresses. If you select a third-party courier for one of these addresses and delivery cannot be completed, you will be responsible for any additional freight, return or redelivery costs.
Bulky Items
Certain products are classified as 'bulky items' due to their size or weight and ship using third-party freight carriers.
Bulky items are excluded from all free shipping offers unless otherwise stated.
Where practical, we recommend ordering multiple bulky items together to maximise the value of your freight charge.
International Shipping
International shipping is available to selected destinations.
International shipping charges are calculated at checkout based on the destination, parcel weight and dimensions.
Customers are responsible for any import duties, customs charges, taxes or other fees imposed by the destination country unless otherwise stated. This will be displayed at checkout and process in one transaction. KI Olives is not responsible for delays caused by customs clearance or border processing.
Authority to Leave
If you authorise your parcel to be left unattended (including by selecting an Authority to Leave option with the courier), delivery will be deemed complete once the parcel has been delivered in accordance with your instructions or the courier's delivery policies.
To the maximum extent permitted by law, KI Olives accepts no responsibility for any loss, theft or damage occurring after delivery has been completed.
Risk and Title
Risk in the goods passes to you upon delivery, including where the goods are left at your nominated delivery address in accordance with your delivery instructions or the courier's delivery policies.
Ownership (title) of the goods remains with KI Olives until full payment for the goods has been received.
Delays Beyond Our Control
While KI Olives will use reasonable efforts to dispatch and deliver orders within the estimated timeframes, we are not liable for delays caused by events beyond our reasonable control, including but not limited to courier disruptions, industrial action, natural disasters, severe weather, public holidays, government actions or other unforeseen circumstances.

12. REFUND & RETURNS POLICY
KI Olives is committed to providing high-quality products and excellent customer service. This Refund & Returns Policy operates in addition to your rights under the Australian Consumer Law (ACL).
Change of Mind Returns
If you change your mind about your purchase, we offer a 10 Business Day return period from the date you receive your order.
To request a return, please contact us at info@kiolives.com.au within this period, quoting your order number.
Change of mind returns are accepted provided that:
- the product is unused, unopened and in its original conditions
- the product is returned in its original packaging or equally suitable packaging;
- the product has not been damaged, altered, dropped or broken after delivery;
- the product has been stored in accordance with any storage instructions provided;
- the return has been approved by KI Olives before being sent back; and
- the product is not a perishable food item that has been opened or otherwise cannot be resold for food safety reasons.
Customers are responsible for all return postage, insurance and freight costs for change of mind returns. We recommend returning items using a tracked or registered postal service, as KI Olives accepts no responsibility for items lost or damaged during return transit.
Returns received without prior approval may be refused and returned to the sender.
Faulty, Damaged or Incorrect Goods
If your order arrives damaged, defective, incorrectly fulfilled, partially fulfilled, or does not comply with the guarantees provided under the Australian Consumer Law, please contact us as soon as reasonably practicable at info@kiolives.com.au, including your order number and photographs where appropriate.
Where a product is confirmed to be faulty, damaged or supplied in error, KI Olives will, in accordance with the Australian Consumer Law and within a reasonable time:
- replace the affected product;
- repair the product (where appropriate); or
- provide a refund to your original payment method.

13. AUSTRALIAN CONSUMER LAW
Nothing in these Terms & Conditions excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law (ACL) or any other applicable law that cannot lawfully be excluded.
Where our goods or services come with guarantees that cannot be excluded under the ACL, you are entitled to the remedies available under that legislation.
14. NATURAL PRODUCTS
KI Olives produces authentic, natural agricultural products. Due to seasonal conditions, climate, rainfall, harvest timing, olive variety and traditional production methods, our products may naturally vary between batches. Variations may include, but are not limited to:
- colour;
- flavour;
- aroma;
- texture;
- size;
- appearance;
- natural sediment;
- oil clarity;
- packaging; and
- product availability.
These natural variations are expected characteristics of premium agricultural products and do not constitute a defect or entitle the customer to a refund.
Customers are responsible for storing products in accordance with any storage instructions provided. KI Olives is not responsible for deterioration in product quality resulting from improper storage or handling after delivery.
15. LIMITATION OF LIABILITY
To the maximum extent permitted by law, KI Olives' liability for any claim relating to the supply of goods or services is limited, at our option, to:
- replacing the goods;
- repairing the goods (where applicable);
- supplying equivalent goods;
- paying the cost of replacing the goods; or
- refunding the purchase price.
KI Olives is not liable for any indirect, incidental, consequential or special loss or damage, including loss of profits, loss of business, loss of opportunity or any other economic loss, except where liability cannot lawfully be excluded under the Australian Consumer Law.
16. PRICING & WEBSITE ERRORS
Whilst KI Olives endeavours to ensure that all information, descriptions, pricing and product availability displayed on the Website are accurate, errors may occasionally occur. We reserve the right to correct any errors, inaccuracies or omissions at any time without prior notice, including after an order has been placed.
Where a pricing or product description error has occurred, KI Olives may cancel the affected order and provide a full refund of any amounts paid.
17. FORCE MAJEURE
KI Olives will not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond our reasonable control, including but not limited to:
- natural disasters;
- bushfires;
- floods;
- drought;
- pandemics;
- industrial disputes;
- transport or courier disruptions;
- government actions;
- power failures;
- supply chain interruptions; or
- other events beyond our reasonable control.
Where reasonably practicable, we will notify affected customers of any significant delays.
18. INTELLECTUAL PROPERTY
Unless otherwise stated, all content on this Website, including text, photographs, graphics, logos, branding, product descriptions, recipes, videos, artwork and other materials, is the property of KI Olives or its licensors and is protected by Australian intellectual property laws.
You may not reproduce, copy, modify, distribute, publish or commercially exploit any content from this Website without the prior written consent of KI Olives.
19. GOVERNING LAW
These Terms & Conditions are governed by the laws of South Australia and the Commonwealth of Australia. Any dispute arising out of or relating to these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of South Australia.
20. SEVERABILITY
If any provision of these Terms & Conditions is held to be invalid, unlawful or unenforceable, that provision shall be severed from the remaining Terms & Conditions, which will continue in full force and effect.
21. ENTIRE AGREEMENT
These Terms & Conditions, together with our Privacy Policy and any other policies expressly referred to on this Website, constitute the entire agreement between KI Olives and the Customer in relation to the use of this Website and the purchase of goods from KI Olives.
These Terms & Conditions supersede all prior agreements, understandings and representations relating to the subject matter to the extent permitted by law.
